Department of Education Answers Questions Surrounding Sexual Harassment & Title IX

In light of changes to Title IX regulations over the past year, and in anticipation of new guidance in the coming months, the U.S. Department of Education (ED) released an FAQ document today addressing questions pertaining to implementation of the 2020 changes and offering insight into how the Office of Civil Rights (OCR) views the responsibility of schools under Title IX. While the ED continues with its review of the current Title IX Regulations, this new FAQ document clarifies how schools can comply with existing requirements.

The list of 67 questions and corresponding answers addresses topics ranging from religious exemption, COVID-19 considerations, and identifying forms of sexual discrimination. The FAQ document includes sample policies to aid schools in efforts to proactively address sexual harassment.

OCR also released a full transcript of the public hearing held June 7-11, 2021, where participants provided testimony about experiences, concerns and opinions relating to Title IX.
